1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Glimoria LTD ("Company," "we," "us," or "our"), a company registered in England and Wales under company number [Insert Company Number] with its registered office at:

By downloading, accessing, or using the MASQD mobile application (the "App"), you expressly agree to be bound by these Terms. If you do not agree to these Terms, you must immediately uninstall the App and discontinue its use.

2. Eligibility & Age Restriction

STRICT AGE LIMIT: You must be at least 18 years of age to use MASQD.

By using the App, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into a binding contract.
  • You are not barred from using the App under the laws of the United Kingdom, Poland, or any other applicable jurisdiction.

Note to Parents: This App is not intended for children or minors. If we discover that a user is under 18, we will immediately terminate their access and delete their data.

3. Anonymity and Accounts

MASQD is designed to be anonymous. You are not required to provide a name, email address, or phone number to use the public feed or chat features. However:

  • Your account is identified internally by a unique device/backend identifier (UID).
  • You are solely responsible for maintaining the security of your device.
  • Because we do not collect personal contact information, we cannot recover your account or chat history if you lose your device or delete the App.

4. User-Generated Content (UGC) & Licensing

4.1. Ownership:

You retain full ownership of the text, messages, and other content ("User Content") that you post, upload, or transmit through the App.

4.2. License to Glimoria LTD:

By posting User Content on MASQD, you grant Glimoria LTD a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content strictly for the purposes of operating, developing, providing, and improving the App.

4.3. Waiver of Moral Rights:

To the extent permitted by applicable law, you waive any "moral rights" or similar rights (such as the right to be identified as the author) regarding your anonymous posts to facilitate the technical functioning of the App.

5. Code of Conduct (Acceptable Use)

To ensure MASQD remains safe and compliant with Apple App Store and Google Play guidelines, strict adherence to this Code of Conduct is required. We have a Zero-Tolerance Policy for abuse.

You agree NOT to use the App to post, send, or share content that:

  • Is Illegal: Violates any local, national, or international law (including UK and Polish laws).
  • Harassment & Bullying: Threatens, harasses, intimidates, or bullies other users.
  • Hate Speech: Promotes violence, discrimination, or hatred against individuals or groups based on race, ethnicity, religion, disability, gender, age, or sexual orientation.
  • Doxxing: Reveals the private personal information of another person (e.g., real names, addresses, phone numbers) without their consent.
  • Sexual Content: Contains pornography, sexually explicit material, or solicits sexual acts.
  • Spam: Constitutes unauthorized advertising, promotional materials, or repetitive spam messages.
  • Harmful Content: Promotes self-harm, suicide, or dangerous activities.

6. Child Safety Standards (CSAE/CSAM Policy)

MASQD is committed to protecting children and ensuring our platform is never used for exploitation. We strictly adhere to Google Play’s Child Safety Standards policy.

6.1. Zero Tolerance for CSAM:

We have a Zero-Tolerance Policy for Child Sexual Abuse Material (CSAM). Any user found posting, soliciting, or distributing content that depicts sexual abuse or exploitation of minors will be:

  • Immediately and permanently banned (Device/IP Block).
  • Reported to the National Center for Missing & Exploited Children (NCMEC) via their CyberTipline.
  • Reported to relevant local law enforcement agencies (e.g., NCA/IWF in the UK, Policja in Poland).

6.2. Designated Point of Contact:

We have a designated safety officer responsible for handling reports related to child safety. For urgent inquiries regarding CSAM or child safety, law enforcement and users can contact us directly at:

6.3. Detection & Reporting:

We utilize user reporting mechanisms and AI moderation tools to detect potential violations. We preserve data related to confirmed CSAM incidents to assist law enforcement investigations, even if the user account is deleted.

7. Moderation & Enforcement

7.1. Platform Authority:

We reserve the right, but do not assume the obligation, to monitor User Content. We act as a passive conduit for your online distribution and publication of User Content. However, upon obtaining actual knowledge of illegal or infringing content, we will act expeditiously to remove access to it ("Notice and Action").

7.2. Violations:

If you violate the Code of Conduct, Glimoria LTD reserves the right to take action without prior notice, including but not limited to:

  • Removing or blocking offensive content.
  • Suspending or permanently banning your access to the App (Device/IP Ban).
  • Reporting illegal activities to law enforcement agencies.

7.3. Reporting:

Users are encouraged to report offensive content or abusive behavior using the in-app "Report" reporting tools found on posts and chat profiles.

8. Fees and Changes to the Service

8.1. Free Service:

MASQD is currently provided to you free of charge.

8.2. Future Monetization:

We reserve the right to introduce premium features, subscriptions, or in-app purchases in the future. We will provide you with reasonable prior notice of any such changes. You will never be charged without your express consent.

8.3. Modifications:

We may update, modify, or discontinue any feature of the App at any time without liability to you.

9. Disclaimers

9.1. "As Is" Basis:

The App is provided on an "AS IS" and "AS AVAILABLE" basis. Glimoria LTD expressly disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2. No Guarantee of Anonymity:

While we strive to protect your privacy, no digital transmission is 100% secure. We cannot guarantee that your identity will never be discovered by third parties (e.g., via sophisticated hacking or legal subpoenas).

10. Limitation of Liability

10.1. General Limitation:

To the maximum extent permitted by applicable law, Glimoria LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, resulting from:

  • Your access to or use of (or inability to access or use) the App;
  • Any conduct or content of any third party on the App;
  • Unauthorized access, use, or alteration of your transmissions or content.

10.2. Consumer Rights Exception:

Nothing in these Terms affects your statutory rights as a consumer. Specifically, we do not exclude or limit in any way our liability to you where it would be unlawful to do so (e.g., liability for death or personal injury caused by our negligence or for fraud).

11. Governing Law & Dispute Resolution

11.1. Governing Law (General):

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

11.2. Protection for EU Consumers (Specifically Poland):

If you are a consumer habitually resident in the European Union (including Poland), you additionally enjoy the protection of the mandatory provisions of the law of your country of residence.

What this means: Nothing in these Terms, including the choice of English law, deprives you of the consumer protections granted to you by Polish law (such as specific rights under the Polish Civil Code or Consumer Rights Act) that cannot be derogated from by agreement.

11.3. Jurisdiction:

Any disputes shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. However, if you are an EU consumer, you may also bring legal proceedings in the courts of the country where you reside (e.g., Poland).

12. Third-Party App Stores

If you downloaded this App from the Apple App Store or Google Play Store:

  • You acknowledge that these Terms are between you and Glimoria LTD only, not with Apple or Google.
  • Glimoria LTD is solely responsible for the App and its content.
  • You must comply with all applicable third-party terms of agreement (e.g., your wireless data service agreement) when using the App.
